§ 2-7005. DISCIPLINARY PROCEDURES: EXEMPT EMPLOYEES.

  • The County Administrator, on his own initiative, may suspend from County service without pay for a period not exceeding thirty (30) days any officer or employee of this County exempt from the Merit System except officers elected by the people and those department heads listed in section 2-5003 (c) for violating this chapter or the rules and regulations adopted pursuant hereto.

    The suspension is valid only if a written notice is served on the officer or employee prior to the effective date of the suspension and a copy of the notice is filed with the Civil Service Commission not later than fifteen (15) days after the effective date of the suspension. The notice shall be served on the officer or employee either personally or by mail and shall include:

    (a)

    A statement of the nature of the punitive action.

    (b)

    The effective date of the action.

    (c)

    A statement of the causes therefor.

    (d)

    A statement advising the officer or employee of his right to answer within ten (10) days of his receipt of the notice.
    If the employee requests a hearing in his answer, his answer shall be deemed a grievance to be disposed of in the same manner as grievances of employees included within the Merit System.
